What this page is / isn't
This is an educational overview of Oregon insurance laws. It is not legal advice. Coverage details can vary by policy.
Personal Injury Protection, commonly known as PIP, is a mandatory part of every private passenger auto insurance policy in Oregon. It is designed to get you medical care quickly after an accident, without arguing over who was at fault.
What Does PIP Cover?
Oregon law (ORS 742.524) mandates minimum coverage, though you may have purchased more. The standard minimums are:
- Medical Expenses: Up to $15,000 for reasonable and necessary medical, dental, and surgical expenses within 2 years of the accident.
- Lost Wages: 70% of your lost income (up to $3,000/month) if you are disabled for at least 14 days. Coverage lasts up to 52 weeks.
- Essential Services: Reimbursement for help with household tasks (like cleaning or yard work) if you are unable to perform them due to injury.
- Funeral Expenses: Up to $5,000.
"No-Fault" Means Faster Care
PIP is "no-fault" insurance. This means your own insurance pays your medical bills, even if the other driver caused the crash.
Why is this good?
- Speed: You don't have to wait for the insurance companies to decide who is to blame.
- Access: Providers can bill your auto insurance directly, similar to health insurance.
- Protection: It ensures you get treatment immediately when it is most effective.
Will My Rates Go Up?
In Oregon, if you are not at fault for the accident, using your PIP benefits generally should not cause your insurance rates to increase. Your insurance company will typically seek reimbursement (subrogation) from the at-fault driver's insurance later.
Choosing a Provider
You have the right to choose your own doctor. You are not required to see a doctor chosen by the insurance company. Many clinics, like those listed in our directory, specialize in treating auto injuries and billing PIP directly.
